1. Who we are

LandSite ("we", "us", "our") provides a Software-as-a-Service (SaaS) technology platform that helps real estate brokers, agents, and developers create, share, and manage online property listing pages. By creating an account, accessing our website, or using our WhatsApp bot, you agree to be bound by these Terms & Conditions.

2. Accounts & Eligibility

To use LandSite, you must be at least 18 years old and legally authorized to market and sell the properties you list.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information. LandSite reserves the right to suspend or terminate accounts that provide false information or engage in suspicious activity.

3. Listings, Content, & Intellectual Property

You retain full ownership of all the content (text, photos, videos, and descriptions) you upload or send to LandSite. However, by submitting content, you grant LandSite a worldwide, royalty-free, non-exclusive license to host, display, resize, cache, and share that content strictly for the purpose of operating the service and rendering your public listing pages.

Your Warranties: You explicitly confirm that you own or have the necessary licenses, rights, consents, and permissions to publish all content you upload. You agree that your listings are accurate, current, and not misleading. LandSite reserves the right to immediately remove any listing or content that we reasonably believe is fraudulent, infringes upon third-party intellectual property rights, or violates applicable law, without prior notice.

4. Regulatory Compliance & Disclaimers

LandSite is strictly a technology platform. We are not a real estate brokerage, agency, or developer. We do not represent buyers or sellers, and we do not partake in any real estate transactions or earn commissions from your sales.

Brokers and developers are solely responsible for complying with all applicable local real estate advertising regulations and maintaining their own RERA (Real Estate Regulatory Authority) registrations where mandated by law. LandSite does not independently verify property titles, ownership claims, or the validity of user RERA registrations.

5. Acceptable Use Policy

While using LandSite, you strictly agree NOT to:

• Engage in spamming, scraping, reverse-engineering, or launching automated attacks on the platform.
• Upload obscene, illegal, discriminatory, defamatory, or copyright-infringing material.
• Impersonate other brokers, agencies, property owners, or LandSite staff.
• Use the platform to facilitate unlawful financial transactions or fraud.

6. Third-Party Integrations (WhatsApp & AI)

When you message the LandSite WhatsApp number, we process the message contents (including text, photos, and videos) to automate the creation of your listing. Your use of this feature is also governed by Meta's (WhatsApp) Terms of Service and Privacy Policy. Additionally, we use third-party AI processors to structure your text. LandSite is not responsible for any downtime, data loss, or hallucinations caused by these third-party integrations.

7. Service Availability & "As Is" Clause

Disclaimer of Warranties

We strive to keep LandSite available 24/7, but the service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or completely secure. We reserve the right to add, modify, or remove features at any time without prior notice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, LandSite, its founders, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, lost data, lost goodwill, or missed real estate deals arising out of your use of the service.

In no event shall LandSite's total liability arising out of or in connection with the service exceed the total amount you paid to us in the three (3) months strictly preceding the event giving rise to the claim.

9. Termination

You may delete your listings or terminate your account at any time via your dashboard. We reserve the right to suspend or permanently terminate your account, without refund, if you breach these Terms, engage in illegal activities, or remain inactive for an extended period.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
